Terms of Use

1. Introduction

Welcome to AtWorks (“Service” or “Software”). These Terms of Use (“Terms”) govern your access to and use of both the online service and downloadable software components of AtWorks. By accessing or using AtWorks, you agree to be bound by these Terms.

2. Acceptance of Terms

By accessing or using AtWorks, you affirm that you are at least 18 years of age or have the consent of a legal guardian. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page with a new “Last Updated” date. Your continued use of AtWorks after such modifications constitutes your acceptance of the revised Terms.

4. Intellectual Property Rights

4.1 AtWorks Software

AtWorks and its licensors retain all rights, title, and interest in and to the Service and Software, including all related intellectual property rights. No rights are granted to you other than as expressly set forth in these Terms.

4.2 User-Created Content

You retain all of your ownership rights in the content you create using the Software (“User Content”). However, by creating content with AtWorks, you represent and warrant that you own or have obtained all necessary rights to the materials incorporated in your User Content.

5. Account Registration

To access AtWorks, you are required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the credentials that you use to access the Service, including passwords, passkeys, OTPs, and any other authentication methods, and for any activities or actions under your credentials. We encourage you to use strong and secure credentials with your account.

6. Use of the Service

6.1 Access Grant

Subject to your compliance with these Terms, AtWorks grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal or business purposes.

6.2 Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove or alter any proprietary notices or labels
  • Rent, lease, lend, sell, redistribute, or sublicense access to the Service
  • Use the Service for any illegal purpose or in violation of these Terms
  • Use the Service in any manner that could damage, disable, overburden, or impair AtWorks’s services or networks

6.3 Service Updates

AtWorks may update the Service from time to time. Your continued use of the Service after an update constitutes your acceptance of the updated Service.

7. Prohibited Use

You agree not to use AtWorks:

  • In any way that violates any applicable national or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
  • To impersonate or attempt to impersonate AtWorks administrators, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which may harm AtWorks or users of the Service, or expose them to liability.
  • For unauthorized copying or distribution of copyrighted media content.
  • To create content that infringes on the intellectual property rights of others.

7.1 Professional Use

The Service may be used in professional and commercial environments. However, you may not use the Service in any scenario that could reasonably be considered offensive, defamatory, or otherwise objectionable.

9. Termination

We may terminate or suspend your account and bar access to AtWorks immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using AtWorks, or notify us that you wish to delete your account.

10. Limitation of Liability

In no event shall AtWorks, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service or Software; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service or Software; (iv) unauthorized access, use or alteration of your transmissions or content; or (v) any defects, bugs, or performance issues with the downloadable software, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

11. Disclaimer

Your use of AtWorks is at your sole risk. The Service and Software are provided on an “AS IS” and “AS AVAILABLE” basis. The Service and Software are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

AtWorks does not warrant that a) the Service or Software will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service or Software is free of viruses or other harmful components; or d) the results of using the Service or Software will meet your requirements.

12. Alpha Access and Future Paid Plans

AtWorks is currently in private alpha and is provided to invited users at no charge.

Paid plans, subscriptions, or other commercial offerings may be introduced in the future. If and when such offerings are launched, the specific pricing, billing, and refund terms will be communicated to you before any purchase and will be incorporated into these Terms. Until then, no payment, billing, or refund terms apply to your use of AtWorks.

Your continued use of AtWorks after any such terms take effect constitutes your acceptance of them.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of AtWorks shall be resolved through binding arbitration in accordance with the laws of India. The arbitration shall take place in Chennai, Tamil Nadu, India and shall be conducted in English.

15. Entire Agreement

These Terms constitute the entire agreement between you and AtWorks regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
